Guys I need some advice on this.How soon can a person file a green card after working for a company? I have a MBA(Finance) and currently working as a Business analyst through a Desi company since last 6 months.I was thinking of filing EB2 through the same Desis.Is it too soon or it is fine to do it now as I have heard that Nepal EB2 is current as of now.Can I file EB2 as a Business Analyst? I also have a feeling that these Desis will try to dealy the filing process,beacause they want to suck you more.What would be the maximum time for the whole process even if these guys delay it? Your responses would be highly appreciated. Thanks Khuitte

Under EB2, you have to wait for 2 years. I mean, you have to have 2 years of experience and USA Master. I think you have the latter one. And other thing, GC is for future reemployment,not for current. So, the position created for you MUST be Master level position. Couple of my friends got their GC from Desi company working as a BA. So, you will be okay, if you fullfill those criteria. They got their GC within 10 months. So, it's current as of now. Hope this help.

NepTalk Thanks for ur response.That means I will have to wait another one & half years to file to have the required 2 years BA experience.Can I show them any other business related experience from Nepal? I think I will probably need to figure out with my company as they know all the trick of the trade. Thanks Khuitte

Khuttie, I am not agree with Nepaltalk. If you have US master degree than you don't need any experience. You can file right now. These are the steps and time frame. 1. Ad posting as per lobor (2.5 month) 2. Labor Certification ( 1 month) 3. I 140 / I 485 filing together ( 8 months) So, within 1 yr you will get your GC in your hand if you do EB2. for EB2 your job requirement (ad posting) must say Master's degree. This is the shortest time frame but desies can prolong it as long as they want so get your own lawyer it costs you around ( 6-10K). I think this will help. May be Saan Dai is right. I am not sure. I said as of my friends process. They told me the same, that we have to show them at least 2 yrs of US experience to be eligible for this. I am also waiting for this. I have been working here more than one and half years with MS in computer science. But you can see this link: http://murthy.com/eb2.html The point of interest is: The LC (Labor Certification) must indicate that the position offered is one that requires the advanced degree to perform the job. If the profession as a rule requires a doctoral degree, the job offer and the credentials of the applicant must indicate / reflect it. Hope other people have more thought about this. Neptalk, I am 100 % sure you don't need any experience if you have Master's degree and job requires Master's degree coz I already started my EB2 process. Hire good lawyer and do it right now. Why you waiting for so long ? already worked for one and half year re...oh god !!! keep update yourself with INS rules. If you had started last yr , you alreadt have GC by now. Saan Dai

Are you sure Saan Dai? I am talking with couple of Desi company regarding this because I found my company is very new in this consulting business. So, many of my friends suggest me, don't apply from there. So, looking and talking with other companies and couple of them suggest me to do the same thing like my friends did. But as you said, if I don't have to wait, then I certainly talk with Lawer and other companies to file mine. If this is true, then I don't have to wait 6 more months to apply it Thanks Saan Dai....

Neptalk , I am sure, . Desi companies always say that coz they want you to work more for them. You need to consult lawyer not a company. Company has to just sign few paperworks, lawyer do all works. So, consult with good lawyer and usually good lawyer ask more money but it is good have good lawyer that cheaper one. Good luck with your GC process. Saan Dai

Thanks saan dai for clearing out the confusion. I have seen people doing it as soon as they get the job. i had the perception that they had used previous experience from Nepal.Then I should start the process soon before it starts to back log. One more question.I got my birth certificate from Nepal, but I realized that it does not have mother's name on it.Will I be able to make a new Birth certificate from the Embassy here and does it work for EB2 filing. Otherwise I am thinking of making new one from Nepal.I had my birth certificate stamped from the Foreign Ministry. Do I need to get a foreign ministry stamp on it if I make it in English from the Nagar Palika itself? Thanks

you can start your process right now! The priority dates are current so thats even better. The only thing that you have to wait is 1 month for the advertisement and 45- 90 days for LOC. Then you are done!!

I don't know about the one that the embassy issues. It is always good to make one from local authority (VDC or Municipality). In the USA, birth certificate is supposed to have both of your parent's name on it. Sometime, USCIS official will not pay much attention and let you go even if your mother's name is missing in birth certificate. I know people who have been issued green card without mother's name in birth certificate. You can try without it but you never know. So, it is always good to make one with both of your parent's name. If you can get one from your Nagarpalika in English, it should be enough. You don't need foreign ministry stamp.
