Sunil jee, it's not clear what your current visa status is.... be more specific... i.e: are you out of status (I'm assuming you have F1 visa) or is your visa expired, are you in OPT?.etc.........

sunil jee, if your case is approved and if you have valid Refugee Travel Document, there is no problem to go to India.

You still have a Nepalese passport, don't you? As for visiting India, you don't need a visa. Citizens of Nepal (and Bhutan) do not require a visa to enter India. However, if they are entering India from a third country other than Nepal and Bhutan, they must have a valid passport. In your case, it's not a problem.

There are rumors about Nepalese being harassed in India but I don't think they are true (even though I haven't traveled through India). India has developed a lot than what we imagine and we haven't been able to change our stereotypical attitude towards India. I am sure you will be asked more questions and scrutinized at the Tribhuwan Int'l Airport if you are planning to go to Nepal (than in India).

you can visit India (and possibly Nepal) without any legal issues. just make your itinerary and book tickets!!!!
