Washington D. C., top lawyer said, based on the justices’ questions, the Supreme Court seems unlikely to favor TPS holders.

Justice Thomas, Justice Alito, Justice Gorsuch, and Justice Kavanaugh seem likely to vote for the government.

Justice Sotomayor, Justice Kagan, and Justice Jackson seem likely to vote for the TPS.

Justice Barrett and Chief Justice Roberts seem careful and cautious. But even if one of them votes with the liberal justices, TPS lawyers may still lose. They would need both Barrett and Roberts to win.

It is very unlikely that both Barrett and Roberts will vote with the liberal justices.
