Hi friends, I really need your help, Right now I am in OPT after graduating in USA univ. In OPT my H1 could not be approved. My OPT's last day is 31 January,07. I know I get 60 days preparation for preparation to leave USA or do some other arrangement. About my disapproved H1 status I came to know just a day ago. Now I want to join a CAPLAn GRE/GMAT course to be in status again till September 07. My employer has told me this year he would file for premium processing right after opening in April,07. My question here is, although I'm trying hard to get into KAPLAN within January, but if in case I am not able to join that within this month, can I join till march,07(60 days grace Period) and still I would not be Out of Status? My second question is : One advisor from KAPLAN was saying that even I join next GRE (which is starting from coming May) I would not be out of status. (Of I can not work legally) Is it true? Please advise me ...... I'll appreciate your kind suggestion... Thanks.............

Hi somewhereinusa, I believe you can be in Status as long as you got admission and paid. May be you can join some other college too. KAPLAN GRE/GMAT course is not academic course and doesn’t have any certain credit hours; I heard it should be 12 Credit hours for international students to be in Status. Did you make any query for this? Good Luck

as far as i know u can stay 60 days after ur OPT status expires and then as long as your new college I-20 start date is within 60 days, then u can be in status.. thats what i have known it to be.. but i could be wrong. i am not a immigration attorney. -lato

the best thing would be i would consult the immigration attorney which u could get by paying 50 dollar for counselling only. jayamatadi

Just listen to Kaplan advisor, they can work it out. I have known few people who have maintained their status through Kaplan. It works.

Brother, U can join community college just for 1 semester and it will maintain ur status. Better hurry up though so u have nothing to lose and please do not break ur status.
