Hi, My consulting company filed my Labor on May 9, 2008 on EB2 category. There is no audit involved and case is still pending according to company's attorney. I'm kind of stressed out by this situation. I wish it would at least get denied or approved, which is better than uncertainty. Its been almost more than 9 months. Does anybody have any idea how long its taking now a days. Also, I'm told by my employer's attorney that I can't check my status online anywhere? Is it true? Thanks in advance!

Only employer and lawyer has access to check the status online. You can check it online if only your employer will provide you their login information. I think it takes about 12-18 months to adjucate the Labor certification these days. Thanks US

Does anyone know how long it takes for DOL to decide if your case should be audited or not? My PERM was filed 6 months ago and when I check the status, it says "In Process".

18+ months if it is audited. I think DOL is not even trying to process any application right now due to the economy. US

Your lawyer will know if it is being audited...they will ask for additional financial documents etc.. US

Latest update! Permanent Labor Certification Applications Still Clogged Since June 2008...
The OFLC has been experiencing backlogs in PERM application processing and there is no report since the end of May 2008 that any PERM cases which were filed in June or thereafter have been adjudicated. The electronic filing and ajudication program of PERM one time led the agency to resolve the tremendously clogged permanent labor certification program very successfully by adjudicating the electronically filed new application as short as in two or three days in some cases. Now, it has turned into a history. Currently it takes more than six months for new applications. The cases in the audit tracks are even clogged since August 2007. The OFLC leaders remain "mute" on the causes of the present problem, but it is obvious that the current problem stemmed from its bold move of auditing all the cases of the nation's largest immigration law firm which led the agency in lawsuit tangle and its aftermath as well as the agency's decision to scrutinize sagging job markets before adjudicating any pending applications. The lawsuit settlement had released some cases in the audit track into the queue of non-audit regular PERM application track which are speculated to be not a small number and which had earlier priority dates. Since the agency is processing cases in the order of the priority date, obviously these cases must have affected later priority date cases. There is some clue that most of these cases may all be adjudicated in the very near future. Accordingly, we anticipate that the processing times of PERM cases may not take as long as what it takes now which is six months.
Lets hope that the PERM program returns to the normal process as soon as possible.

Most companies dont hand that out. I ask the law ferm handling the case to send me a screenshot, whenever I want to view it.

Hi All, I found some of the labor PERM approved for EB2 which was applied in June-July 2008 by Atlanta. Even some of the EB3 labor has been approved applied around those time. Looks like it entirely depends on unknown factors! Even now, new labor PERM might get approved in 3-4 months if you are lucky from my understanding. I could not find any kind of pattern here! What do you all think?
